Digital Millennium Copyright Act Notice
Anthony Bahn Tech ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
DMCA Safe Harbor
We qualify as a "service provider" under the DMCA and maintain DMCA safe harbor protection. If we receive a valid DMCA takedown notice, we will respond by removing or disabling access to the allegedly infringing material. We will also make a good-faith attempt to contact the person who posted the material so they may make a counter-notification.
Filing a DMCA Takedown Notice
If you believe that content on our website infringes your copyright, please send a written notice to our designated agent that includes the following information:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, provide a representative list.
Identification of the material that is claimed to be infringing and that is to be removed, with sufficient detail so we can locate it (e.g., the specific URL).
Your contact information, including your address, telephone number, and email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Counter-Notification Process
If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for your address (or the Northern District of California if outside the U.S.)
- A statement that you will accept service of process from the person who filed the original DMCA notice
Upon receiving a valid counter-notification, we will forward it to the original complainant. If we do not receive notice within 10-14 business days that the original complainant is seeking a court order, we may restore the removed material.
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Misrepresentation Warning
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
Before filing a DMCA notice, please ensure you have a good faith belief that the material actually infringes your copyright.
